Summary Judgment in $40M Commercial Dispute

Kansas Penn Gaming, LLC v. HV Properties, LLC

(U.S. District Court for District of Kansas; U.S. Court of Appeals for the Tenth Circuit)

Obtained summary judgment in favor of client casino gaming company in declaratory judgment action against real estate developer, and on developer’s counterclaim, in which developer sought over $40 million in damages from gaming company for withdrawing from casino development project. Court also ordered developer to pay nearly $1 million in gaming company’s attorney’s fees and expenses. The firm successfully got both orders affirmed on appeal.
