Following over 2 1/2 years of litigation, the Firm’s client Garmin received an order dismissing the case on summary judgment and a denial of class certification.  In addition to finding that Plaintiff’s claims failed as a matter of law, the Court found the undisputed evidence vindicated Garmin’s position that even after four years of use, plaintiff’s device had not reached the end of its useful life.  The Court’s Memorandum and Order thus not only represented complete victory for Garmin, but demonstrated that the batteries used in Garmin personal navigation devices meet reasonable consumer expectations.
