Kmak v. American Century Companies, Inc.

In Kmak v. American Century Companies, Inc., the United States Court of Appeals for the Eighth Circuit unanimously affirmed the summary judgment ruling on all claims that the firm obtained in the district court for our client American Century. The case involved stock options that Mr. Kmak had exercised while employed at American Century and the company’s later exercise of call rights on that stock. The courts ultimately rejected Mr. Kmak’s claims that the company acted in bad faith in connection with the call rights on the stock, and The Eighth Circuit’s opinion on October 19, 2017 represents a complete victory in this case for American Century.
