$6.1M Jury Verdict for PHC Holding Company, LLC

Jackson County, Missouri Represented Defendants/Counterclaim-Plaintiffs in successfully obtaining a $6.1 million jury verdict for breach of fiduciary duty and civil conspiracy, including $5.5 million in punitive damages, following a thirteen-day jury trial in Jackson County, Missouri. The plaintiffs initially filed claims against clients on various theories, all of which were dismissed by the Court prior to trial. At trial, persuaded the jury that Counterclaim-Defendants improperly used their control over Counterclaim-Plaintiffs to take monies for lavish personal entertainment and other self-dealing transactions, and that the award of punitive damages was appropriate to deter future conduct. Complete victory in case for American Century

Kmak v. American Century Companies, Inc. United States Court of Appeals for the Eighth Circuit In Kmak v. American Century Companies, Inc., the United States Court of Appeals for the Eighth Circuit unanimously affirmed the summary judgment ruling on all claims that the firm obtained in the district court for our client American Century. The case involved stock options that Mr. Kmak had exercised while employed at American Century and the company’s later exercise of call rights on that stock. The courts ultimately rejected Mr. Kmak’s claims that the company acted in bad faith in connection with the call rights on the stock, and The Eighth Circuit’s opinion on October 19, 2017 represents a complete victory in this case for American Century.

Complete victory dismissing class action for Garmin

Meyers v. Garmin Int'l, Inc., et al. United States District Court for the District of Kansas Following over 2 1/2 years of litigation, the Firm’s client Garmin received an order dismissing the case on summary judgment and a denial of class certification. In addition to finding that Plaintiff’s claims failed as a matter of law, the Court found the undisputed evidence vindicated Garmin’s position that even after four years of use, plaintiff’s device had not reached the end of its useful life. The Court’s Memorandum and Order thus not only represented complete victory for Garmin, but demonstrated that the batteries used in Garmin personal navigation devices meet reasonable consumer expectations.

$31M Jury Verdict for Hallmark Cards Affirmed on Appeal

Hallmark Cards, Inc. v. Monitor Clipper Partners, LLC United States District Court (W.D. Mo.) Following a 10-day federal court trial, we obtained a jury verdict for $21.3 million in actual damages and $10 million in punitive damages in favor of Hallmark in a trade secret misappropriation lawsuit against private equity firm Monitor Clipper Partners. This verdict was affirmed in full by the 8th Circuit Court of Appeals in July 2014. Monitor Clipper used Hallmark trade secrets entrusted to a sister company, and forensic analysis uncovered evidence of data destruction by key employees of Monitor Clipper. The victory followed collection of a 2010 settlement for $12.5 million from Monitor Company Group.

$373M Arbitration Award Confirmed, Collected for American Century

American Century Investment Management, Inc. v. J.P. Morgan Invest Holdings, LLC AAA Arbitration, Award Confirmed in Circuit Court of Jackson County, Missouri At conclusion of six-week arbitration of breach of contract dispute against J.P. Morgan, we obtained a $373 million award in favor of American Century. Award was confirmed at trial court level, and a total of nearly $384 million was paid to our client (including interest). This is the largest known collected judgment in Missouri history.

KCPL – $452M Jury Verdict

Kansas City Power & Light Co. v. Rockwell Automation, Inc. (Jackson County Circuit Court) Obtained $452 million jury verdict for KCPL on product liability claims arising out of power plant explosion. After trial court reversed the verdict, the firm successfully appealed and the verdict was reinstated in full.
